We shall execute your order at the Final Price (according to the rate at the time of our trade execution), as soon as reasonably practicable and up to 120 hours, , after your completion of our registration, AML and KYC processes to our satisfaction and after the transaction has been confirmed by the payment provider used to deposit the (bank , cc, etc.). Until Execution, any order by you shall be considered as pending and not completed, and shall not be binding on us whatsoever. Any payment or delivery by us to you of Fiat Money or Digital Currency, as applicable, shall be made after deduction of any applicable fees, including our exchange fee of 4.7% for a clients’ purchase of a Digital Currency (buy) and a 4.7% exchange fee for a clients’ sale of a Digital Currency (sell).. Beegbit commissions 

Beegbit charges a commission of 6% on the total amount of each transaction conducted through our exchanger. The commission is calculated based on the total transaction amount before any other fees or deductions.The commission will be automatically deducted from the transaction amount at the time of the transaction.

Verification code

Beegbit has implemented verification system regarding each payment made to Beegbit from its clients. You as a Client during making a payment receives a verification code to your phone in order to approve transaction you are making. This verification code is a confirmation that transaction is authorized and conducted solely and personally by you, as well as this is confirmation that you was aware about a transaction you made and completely informed about the services you purchased from Beegbit. Without the verification code any transaction to Beegbit could not be processed.

Liquidated damages
You as Client confirms your awareness and agreeing that in case that you as Client will initiate any cancellation act against Beegbit after receiving the service from Beegbit, you will be liable and agree to pay us liquidated damages without a proof of damage in the amount of 15,000 EUR.

You declare and take the obligation, in case you receive cryptocurrency from Beegbit, and from any reason your funds will not be received to Beegbit, or after Beegbit receives the funds, the funds will be sent to your bank, you will be obliged and liable to pay to Beegbit the amount of the cryptocurrency you received. You declare and agree if you breach this obligation, you shall be liable for the liquidated damages (agreed compensation) of 15,000 euro (this compensation is not limited to any other remedies of Beegbit according to the law).

beegbit through the online platform https://beegbit.com/, allows users to sell or buy cryptocurrency; The exchange rate will be set by beegbit at the moment when the amount transferred by the user arrives beegbit’s bank accounts. In case of high volatility in the market, in particular the change of the price/rate by more than 1.00% between the launch of the order ( initial price ) and the settlement, beegbit reserves the right to settle the transaction the trade in crypto, regardless of the value, at the best available price when the funds are available in beegbit bank accounts. The trade is completed in beegbit work program ( Monday-Friday, except for official non-working days). There may be situations where, due to high volatility, the customer will incur a recalculation of the purchase price when beegbit has the possibility to buy and deliver the cryptocurrency to the customer. Starting a trade ( purchase/buy ) without transferring the funds, can lead to the cancellation of the account with beegbit. We do not accept cash deposits at the bank. The client will make the transfer only from another bank account to beegbit’s listed bank account for a particular currency. The approval of the transaction may take from a few minutes to up to five ( working ) days, depending on the availability of the client’s funds to beegbit, the value of the purchase, the account history, and market volatility. The confirmation of the transaction by the crypto-currency network ( blockchain ) varies depending on the fluidity of the network or on the congestion of it. Cryptocoins purchased cannot be sent back without a confirmation from our side;

Registration 

You may open only one account on beegbit trading platform. If you try to open more than one account, such an additional account may be suspended or closed, at our discretion. To use any of the services beegbit, you must register first by providing an email address and password. Upon successful completion of the registration process, beegbit will determine your beegbit account. To open an account with beegbit, the client must add to his registration a valid proof of identification (ID, passport ) and also a valid proof of address ( bill, invoice not older than 3 months that has the client’s name on it ). Documents verification may take up to 5 business days. 

beegbit may, at its sole discretion, refuse to allow someone to establish an account with beegbit. From time to time, we may also ask you to provide additional information as a condition to continue the use of our Services. If you want to convert local currency into cryptocurrency or crypto currency in local currency authorized by beegbit, directly or through third parties, beegbit can make any demands that we consider necessary to validate your identity. This may include requesting further information about the user, such as name, date of birth, email address, physical address, tax identification number, identification number and information about your bank account (eg a financial institution, account type, account number) so that we can confirm your identity and for the user to benefit from the services provided by beegbit. beegbit may seek you to answer any questions or take measures to verify your identity; thus respecting the law. 

By transmitting sensitive information which may be required, please make sure the information is accurate and authentic and that you agree to inform beegbit if you change any basic information requested. When using a Credit and/or Debit card to buy Crypto Currencies, from time to time, we will require to verify that you are authorized to use this card/own the account. We reserve the right to keep your Registration Information account after you close the account for regulatory purposes and compliance with business rules. 

Password security and keeping current contact information 

You are responsible for maintaining the security and proper control of any ID and all IDs, passwords, information, personal identification numbers (PINs) or any other codes that you use to access the services beegbit. Any loss or compromise of the above information and/or personal information can result in unauthorized access to your account online with beegbit by third parties. You are responsible for keeping up to date your email address in your account to receive any notifications or alerts that we send. beegbit shall not be liable for any loss or damage caused by failure to comply with rules protecting account information, or failure to follow or take note of any notifications or alerts that we send. If you feel that your account information has been compromised, contact Support or Contact beegbit as soon as possible. beegbit does not have any responsibility for any damage or disruptions caused by computer viruses, spyware or other malware that can harm your computer or other equipment, or any phishing, spoofing or other attacks.  Suspension and closing of the account 

It may be the case, at our sole discretion without liability to you or any third party, to refuse to open an account, to your account suspended or you terminate your account or how it works on one or more services. Or, in accordance with the requirements of a valid subpoena or court order, or if beegbit reasonably suspects you to be using your beegbit account in order to promote illegal activities; but not limited to; or opening multiple accounts beegbit or abuse of promotions that beegbit can provide from time to time, your account may be suspended.

 If you have unsettled trades in an account that has been suspended or closed, you will be able to recover these funds, unless prohibited by law or court order. beegbit, at its discretion, will allow you (i) to withdraw these funds to your bank account which already known, or (ii) may send funds to an external cryptocoin known wallet address. We reserve the right to require the provision of further identifying information before processing such agreements and to delay or prohibit these agreements, if beegbit considers that there were fraudulent or illegal activities. If you are unable to connect to your account, you should contact assistance services to process such agreements. 

You may terminate this Agreement at any time by discontinuing use of the Services offered by beegbit. Upon termination of this Agreement and suspend of your account, you remain liable for all transactions made while the account was opened. 

The right to suspend or delay transactions and settlements 

beegbit reserves the right to refuse to process or cancel any transaction or cryptocurrency being connected to your local currency at beegbit or any services, as required by law or in response to a subpoena, a court order or another binding. beegbit cannot reverse a settlement of a cryptocurrency which was communicated and confirmed by a special cryptocurrency network. beegbit reserves the right to refuse a process or cancel it on any purchases or sales of cryptocurrency or transfers, at its sole discretion. If beegbit suspects the transaction involves (or has a high risk of involvement in) money laundering, terrorist financing, fraud or any other type of financial crime in response to a subpoena, a court order or other governmental order, or if beegbit suspects that the transaction relates to a restricted activity. We reserve the right to change, suspend or discontinue any aspect of the Service at any time, including the hours of operation or availability of any facilities without notice and without any liability. We may refuse to process any transaction or settlement without notice and can limit or suspend your use of one or more services at any time at our sole discretion. Suspension for use by you of any of the services will not affect your rights and obligations under this Agreement. There may be the case, in our sole discretion, to delay transactions or agreements, if we believe that the transaction is suspicious, or it may involve fraud or irregularity, violate laws or violate the terms of this agreement. 

If a technical problem is causing system errors, interruptions of function or account, beegbit may temporarily suspend online access to your account until the problem is solved. beegbit may, at the customer's verbal or written request can keep his/her cryptocoins indefinitely until the client requests in writing or verbal the return of these cryptocoins, or their value from the day in which the request is made on the platform of beegbit. Payment is made to a bank account that belongs to the client. beegbit does not take responsibility for the lack of communication with the client and does not presume the customer's intent in these situations. In case of high market volatility, unanticipated situations on the economic scene or natural disaster, transactions and payments may incur delays. beegbit shall not be liable for these delays, having no control over these possible events. beegbit reserves the rights to authorize transactions and capture/settle the amount only after the product will be delivered. 

Withdrawing from a trade 

You do not have the legal right to withdraw out of a transaction to buy or sell cryptocurrency once you started this process with beegbit, because the price cryptocurrency fluctuates in accordance with the financial markets, and all of the above are beyond the control of beegbit. 

Taxes 

It is your sole responsibility to determine whether and to what extent any charges apply to cryptocurrency transactions, conducted through beegbit; and to withhold, collect, report and remit taxes to the correct values to the appropriate tax authorities.

b. Legal Requirements: If compelled by law enforcement agencies or regulatory authorities, the exchange may terminate or suspend user accounts to comply with legal obligations. 

c. Security Concerns: In cases where the security of the exchange or its users is compromised or at risk, the exchange may take necessary actions, including the termination or suspension of accounts, to mitigate potential threats. 

d. Non-Activity: Accounts that remain inactive for an extended period, as defined by the exchange's policies, may be subject to termination or suspension. 

e. Non-Compliance: Users failing to comply with identity verification procedures or failing to provide requested documentation may have their accounts terminated or suspended. 

f. Breach of Security: If a user's account is compromised due to their negligence in safeguarding account credentials or other security measures, the exchange may terminate or suspend the account to prevent further unauthorized access.

Complaints Policy 

If you have a complaint regarding our services, please bring it to our attention promptly. We are committed to resolving complaints fairly and in accordance with applicable Polish regulations and laws. Upon receipt of your complaint, we will acknowledge its receipt within 3 business days. 

We will then thoroughly investigate the issue and aim to provide a substantive response within 15 business days. If, due to the complexity of the issue, we require more time, we will inform you and endeavor to resolve your complaint within 30 business days of its receipt. 

 All complaints should be submitted in writing, providing as much detail as possible, to enable us to investigate and respond effectively.

 Governing Law and Dispute Settlement 

These Terms ans Conditions and the relationships between parties will be construed and enforced in accordance with the laws of Poland. The parties shall attempt to resolve any claim or dispute between them arising out of or in connection with these Terms and Conditions or their relationships through negotiation in good faith. Any legal actions or proceedings arising out of or relating to these Terms and Conditions or relationships between parties shall exclusively be brought before the courts of Poland, to which both parties hereby irrevocably submit. 

The Card Holder Responsibility 

The right to use some of the services offered in our website may be illegal in certain countries. It is your responsible for determining whether the use of the website and services is compliant with applicable laws in your jurisdiction and you warrant to us that the use of our services is not illegal in the territory where you are currently located and you agree to comply with all applicable laws, statutes and regulations regarding our website and the services offered through the website. 

Refund Policy 

 In rare circumstances, Osterwetus sp. z o.o. reserves the right to either cancel your order or offer you a different price for the Services. In the event we cancel your order, if we have already received FIAT Currency from you with regards to such order, we will, subject to applicable law and regulation,refund such funds to you. Refund shall be made to the same source from which they have originated, after deduction of any cost or expense we incur with regards to such transfer, including without limitation any wire transfer charges, currency exchange charges and/or payment processing charges. Your funds may, at Osterwetus sp. z o.o.s sole discretion, be returned to another source to which you are the beneficiary, as long as you provide us with the required documents and information to verify that the account to which the funds were requested to be refunded belongs to you. To comply with anti-money laundering and terrorist financing regulations or any other regulations and to prevent prohibited conduct, all payments and information related to the refund may be verified by Osterwetus sp. z o.o.. In such case, Osterwetus sp. z o.o. may request from you, at its sole discretion, to provide certain documents and information, including without limitation identification documents, copy of your credit card (Front – we need to clearly see your name, expiration date, first 6 and last 4 digits of the card number. For security purposes you must cover the middle 6 digits using a SMALL strip of paper. Back – we need to see your signature in order to validate the card. For security purposes you must cover the CVV using a SMALL piece of paper but we must be able to see the rest of the information on the back of the card) or bank details and/or any other proof required to affect the refund. In case you fail to provide appropriate documents or information, or in case of any doubts as to the authenticity of provided documents and information, Osterwetus sp. z o.o. shall be entitled to cease the refund process until you take appropriate measures, as requested. 

The provisions of this refund policy shall apply mutatis mutandis to any return of Cryptocurrency already received from you prior to cancellation of your order, from which the then-current equivalent amount of Cryptocurrency to such costs and expenses shall be deducted. It is hereby understood, agreed and confirmed by you that due to Cryptocurrency price volatility, we are unable to refund the exact Cryptocurrency amount received, therefore that amount of Cryptocurrency refunded shall be calculated based on its USD value at the date of transaction between you and Osterwetus sp. z o.o. with respect to such Cryptocurrency (without derogating from our right to deduct from such refund any cost and expense we incur with regards thereto, as specified above). Notwithstanding the above, Osterwetus sp. z o.o. reserves the right to cancel your order without any refund, or decline any refund request, if it suspects that you have or are engaged in, or have in any way been involved in, fraudulent or illegal activity. 

Refund will be processed without undue delay, and in any event within 7 (seven) business days from cancellation of order, subject to the requirements set forth hereinabove, and provided that you do not fail to provide Osterwetus sp. z o.o. with any information and/or documentation required in order to process the refund. 

Any charges, which arise upon processing Refund/Return, shall be borne solely by the User. Such charges will be deducted from the final amount of Refund/Return.

This Refund Policy will be amended from time to time if there is any change in the legislation. Terms and conditions of the Refund Policy are subject to change by Beegbit and in the case of any amendments, Beegbit will make an appropriate announcement. The changes will apply after Beegbit has given notice.

In case if the User does not wish to accept the revised Refund Policy, he/she should not continue to use Beegbit Services. If the User continues to use the Services after the date on which the change comes into effect, his/her use of the Services to be bound by the new Refund Policy.

PAYMENT TRANSACTIONS AND FRAUD

You are fully responsible for paying all FIAT Currency, and for delivering all Cryptocurrency, owed to us by you. We may cease to provide the Services or withhold payment to certain clients, for any reason whatsoever including without limitation the type of credit/debit card used for payment.

We reserve the right not to credit wire transfers to you until Beegbit can properly identify and authenticate your identity or payment account (as applicable).

We may use third party electronic payment processors and/or financial institutions to process payments made by and to you in connection with your use of the Services. If we reasonably believe that a fraudulent payment is being made or received, including use of stolen credit/debit cards, or any other fraudulent activity (including without limitation any chargeback or other reversal of a payment), we reserve the right to close a client's account, terminate the Terms & Conditions and reverse any pay-out. We shall be entitled to inform any relevant authority or entity (including credit reference agencies) of any payment fraud or otherwise unlawful activity and may employ collection services to recover payments. We shall not be liable for any unauthorized use of credit/debit cards, irrespective of whether the credit/debit cards were reported stolen.

You agree to keep a copy of credit/debit card transaction receipts for a period of minimum 3 (three) months following any transaction made by you with us.

In the event you as Client made a transaction to Beegbit and do not cooperate with us according to our instructions, among others according to KYC instructions, we will attempt to contact you to make a refund of your transaction. However, if we are not successful to reach you, for security reasons we will hold the refund on Beegbit account until you/ your Client's bank will contact us and we will make sure that you is a real person and the same person as registered on Beegbit.

CRYPTOCURRENCY SALE PRICE

-       All Cryptocurrency sale prices shall be defined in section “BUY BTC” on Beegbit.

-       It is generally known that Cryptocurrency price is highly volatile. Therefore, you understand that final price of Cryptocurrency you buy may differ in comparison with the initial one, which you could have seen before on Beegbit.

-       You agree that while using a bank transfer as a payment method the sale rate may be different from the rate which was shown on Beegbit while your order has been initiated. This is due to highly volatile nature of Cryptocurrency.

-       You consider possible sale rate changes when you purchase Cryptocurrency. Consequently, you agree with final sale price of Cryptocurrency, which can be determined only after transaction results according the Cryptocurrency sale rate at the moment when we receive your transaction.
